Terms of Use & Conditions

The customer agrees to terms and conditions by using any services provided by VCM Technologies Inc.

1. Authorization

1.1- The Customer grants permission to VCM Technologies Inc. to carry out a number of tasks, including evaluation of data loss situation, recovering data, fixing recovered data and/or carrying out other associated tasks.

1.2- The customer acknowledges that the warranty on their device may be void if VCM Technologies Inc. needs to open their hard drive or other device for diagnosis or repair.

1.3- We will make reasonable attempts and use our knowledge to try to recover your data if you agree to the data recovery, but we cannot promise that any data will be retrieved. By utilizing our services, you acknowledge that our attempt to recover the data may result in damage to the device, media, or data and may leave all or a portion of your data irretrievably lost. You also acknowledge and covenant that you will indemnify and hold VCM Technologies Inc. blameless from any and all damages to that effect.

2. Legal Rights

2.1- The customer guarantees that any equipment, media, and data gave to VCM Technologies Inc. are legally theirs.

3. Recognition of Preexisting Conditions

3.1- Customer acknowledges that any data storage devices or equipment subject to analysis or processing under this agreement may have pre-existing damage or other problems, and that VCM Technologies Inc. is unable to assume responsibility for such damage or additional problems resulting from such pre-existing damage due to such damage.

3.2- Customer understands and accepts at their sole risk that VCM Technologies Inc.'s provision of the services may not lead to a full recovery of the data.

4. Confidentiality

4.1- VCM Technologies Inc. commits not to reveal any information or data files supplied with, stored on, or retrieved from Customer equipment.

4.2- Customers' data will only be stored on site for a maximum of one week due to rigorous confidentiality requirements.

4.3- The customer is in charge of confirming the recovered data and notifying VCM Technologies Inc. via email or another method within one week. The whole liability of a Customer lies with them if they don't verify the recovered data within one week. Any additional claims will not be covered by VCM Technologies Inc's liability.

4.4- The data that the customer receives from VCM Technologies Inc. should be backed up by the customer. Any data loss or disk failure will not be the responsibility of VCM Technologies Inc.

4.5- Hard drives used to deliver the recovered data to the customer are not covered by a warranty by VCM Technologies Inc.

5. Payment

5.1- The customer compromise to pay VCM Technologies Inc. any fees associated with the Services, such as any necessary charges for evaluation, recovery, shipment, any relevant taxes.

5.2- If new media (e.g., HDD, Flash Drive, Micro SD) or replacement part (e.g. HDD PCB, Video card, RAM memory, motherboard, screen or any other part) is needed, it will be required to pay in advanced and it is non-refundable.

5.3- If a successful recovery is completed, payment must be made in full before data is released, unless a particular prior arrangement has been made.

5.4- We will let you know and not charge you for our efforts if we are unable to recover any data.

6. Case That Was Ignored

6.1- The customer acknowledges that any items that have not been claimed within ninety (90) days of the evaluation's completion, regardless of whether the customer has paid for any services rendered, will be considered abandoned by the customer and disposed of (including all data/media containing data), at the customer's discretion.

6.2- All data included in abandoned media will be destroyed without chance to recover it.

7. Agreement

7.1- All changes to this Agreement must be made in writing and signed or acknowledged by both parties.

7.2- This Agreement is intended by the Parties to be the final expression of their agreement, and it constitutes the full and entire understanding between the Parties with respect to the subject hereof.
